Dictators have no respect for courts or any independent and impartial judicial  system on any level and will interfere and try to manipulate courts if they feel like it.

Dictators will often scapegoat a religious, ethnic, or racial group to gain favor with a majority group in a publicity campaign, which will deflect difficulties or illegal procedures that are actually going on within the government.

Another advantage of fake Declarations of national emergencies for the dictator is the opportunity to silence or completely obliterate his opposition and/or critics with the retort that the ever-present "danger" makes any criticism or opposition against the national interest.

The only way this can be done if someone commits perjury during any Congressional testimonies. But under the "general statute" is hard to prove.

Venting isn't illegal, called First Amendment, but claiming a false accusation is considered slander but that's for the civil court.
