From his days on the Hill as Chief Counsel to Judiciary, Breyer will go down as someone who sought consensus and viewed himself as pragmatic. Remember he was one of the justices who along with Souter agreed to the equal protection rationale to stop Fla recount in Bush v Gore.

D.C. Circuit Court Judge Ketanji Brown Jackson and California Supreme Court Justice Leondra Kruger — both highly accomplished Black female judges — are seen as the early front-runners to replace retiring Supreme Court Justice Stephen Breyer.

Jackson was confirmed by the Senate to the powerful D.C. Circuit just last summer, with the vote of every Democrat.

More recently, she was part of a panel that said Trump had to turn over documents to the Jan. 6 committee.

Kruger served in the Justice Department during the Obama administration, arguing a dozen cases before the Supreme Court.

She has a reputation on the California Supreme Court as moderate and incrementalist.
